BRIEF DESCRIPTION OF CONTEST

The Tonton & Menang “Saya Nak Cuti”! Contest is a contest organized by Malaysian Airlines System Berhad in collaboration with ASTRO (collectively the “Organisers”).

This is a weekly contest based on “Saya Nak Cuti” weekly episodes. There will be 1 winner weekly and 7 winners in total throughout the show. The winner of this Contest will receive 2 Malaysia Airlines economy class air tickets to the destination highlighted on the show. The winner will be announced on mastraveller.com/sayanakcuti page.

INTRODUCTION

The Contest is subject to these terms and conditions (“Terms and Conditions”).

This Contest will be held on a weekly basis with 7 cycles throughout all the 7 episodes of “Saya Nak Cuti” show. All 7 contest cycles will start from 29 April 2010 until 18 June 2010 (“Contest Cycles”). All contest cycles shall close at 11.59 pm on every Friday or such other time that the Organisers shall decide from time to time (“Entry Deadline”). Entries received after the Entry Deadline will be ineligible to participate in the Contest and hereafter win any prizes.

The Organisers reserve the right to vary, postpone or re-schedule the dates of the Contest or extend the Contest Period at their sole discretion.

The brief mechanism of the Contest is as follows:-

The Contest will be organised by the Organisers in the Bahasa Malaysia language. The contest entries (as hereinafter defined) have to be made in Bahasa Malaysia language as well.

The Organisers reserve the right at any time to change, amend, delete or add to the Terms and Conditions and other rules and regulations including the mechanism of the Contest at their absolute discretion.

The Organisers may terminate or suspend the Contest/Programme at any time at their absolute discretion in which case, the Organisers may elect not to award any prizes. Such termination or suspension shall not give rise to any claim by the Contestants. If the Contest is continued by the Organisers, the Contestant shall abide by the Organisers’ decision regarding the continuation of the Contest and disposition of the prizes.

CONTEST ENTRY

Participants can only submit one submission weekly

The answer must be complete, accurate, spelled correctly and sent to the Organisers by logging on to www.mastraveller.com. The slogan must not exceed the number of words stipulated above. Entries must be received by the Organisers on or before the Entry Deadline. Entries received after the Entry Deadline will be cancelled and will not be eligible for any Prizes (as hereinafter defined).

By submitting the answer and the slogan, participants shall be deemed to have read, understood, accepted and agree to be bound by the Terms and Conditions of the Contest.

Submission of the answer does not guarantee participants the opportunity to participate in the Contest. The Organisers shall be entitled to reject or refuse participation by the participants for any reasons whatsoever, including (without limitation) where the participant’s contact details at mastraveller.com database is not complete, illegible or any provisions in the Terms and Conditions are not fulfilled or adhered to by the participant.

ELIGIBILITY

The Contest is open to all Malaysian citizens aged 18 years and above as at 29 April 2010, and must possess a valid Malaysian Identity Card or Birth Certificate.

Participants may be required to submit further proof of their eligibility within such timeframe as may be required by the Organisers failing which the Organisers shall be entitled to disqualify the participant.

DISQUALIFICATION

The Organisers reserve the right to disqualify a participant and/or revoke any Prizes (as hereinafter defined) at any stage of the Contest if:-

In the event of a disqualification after a prize has been awarded, the Organisers reserve the right to demand for the return of the Prize or payment of its value from the ineligible or disqualified winner.

WARRANTIES

The participant represents and warrants to the Organisers that :-

DECISION OF THE JUDGES/ORGANISERS

The Organisers will select the winner from all the entries received by the Entry Deadline. The selection of the winner shall be based on the correct answer with the slogan that fulfills the following criteria: originality , compelling reasons, and ability to capture interest.

The Judges/Organisers’ decision on matters relating to the Contest (including without limitation, the selection of the questions and winners) shall be final and absolute. No discussion, correspondence, enquiry, appeal or challenge in respect of any decision of the Organisers will be entertained.

PRIZES

The winner shall win 2 Malaysia Airlines return economy class air tickets. The ticket excludes airport tax, fuel surcharge, insurance and administrative fees.

The winner will be notified via email and mastraveller.com on best efforts basis. The Organisers reserve the right to use any other method or medium it deems fit at its sole and absolute discretion for the purpose of announcing the winner.

In the event the winner is not able to receive, take up and/or utilize the Prize as detailed for reasons not attributed to the Organisers, the Organisers reserve the right to select an alternative winner. The Organisers shall not arrange for another prize or compensation in kind.

The winner is required to provide contact details, passport, NRIC or birth certificate numbers and any other details that may be deemed necessary and relevant for the Organisers in its sole discretion, as and when requested/notified by the Organisers for the purposes of verification. Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to the Organisers does not denote proof that the Organisers have received such details.

The Organisers reserve the right to forfeit any prizes due to the failure of any winner to provide the required details upon receiving the request/notification from the Organisers and the Organisers, shall have no liability to the winners in any respect whatsoever. The Organisers reserve the right to appoint a third party to conduct the verification of winner and the winner agrees that the Organisers may provide all necessary information of the winner to such third party to facilitate such service.

The Organisers do not guarantee the availability of the Prize and the Organisers shall be entitled to replace and/or substitute such Prize(s) with any other prize(s) of similar value as determined by the Organisers, at its sole discretion.

The prizes are strictly non-transferable, assignable, exchangeable or redeemable by the winner in any other form or manner other than that specified by the Organisers. All specific or special terms and conditions that are attached to the Prize must be adhered to by the winner.

The winner is responsible for any and all taxes, levies or duties payable as a result of a Prize being awarded or received (if applicable).

In the event that the winner chooses not to accept a Prize, the Prize shall be forfeited and the Prize shall be dealt with in accordance with the absolute discretion of the Organisers.

The Prizes are accepted entirely at the risk of the winner and is awarded by the Organisers without any warranty of any kind,either express or implied. The winner shall execute a deed of release and indemnity in a form prescribed by the Organisers, if so required, in order to receive the Prize.

Prizes must be collected in accordance with the dates and destinations specified by the Organisers, failing which it shall be forfeited. No cash alternative or alternative arrangement will be offered by the Organisers, their agents or sponsors.

Prizes must be collected in accordance with all terms and conditions as may be set by the Organisers, including (without limitation) the following:-

The winner must hold a valid passport with at least one (1) year’s validity period. It shall be the responsibility of the winners to obtain the necessary visas and other travel documents at their sole cost and expense. No compensation whatsoever will be given should the winners fail to obtain such documents, regardless of the circumstances.

Passport control and in-country authorities reserve the right to refuse entry. If a winner is refused passage, entry or exit to or from the country being visited, the Organisers will not be responsible in any way to compensate the winner for such refusal of passage, entry or exit and any additional costs incurred will be at the sole cost and responsibility of the winner.

Notwithstanding any provisions herein and/or in the event of unforeseen circumstances or circumstances beyond the reasonable control of the Organisers. The Organisers reserve the right to offer alternative arrangements of approximately similar value. No cash alternative will be offered.

GOVERNING LAW

The Terms and Conditions of the Contest shall be construed, governed and interpreted in accordance with the laws of Malaysia.

GENERAL

The Organisers, their agents, sponsors and representatives shall not be liable to perform any of their obligations in respect of the Contest and these Terms and Conditions, rules and regulations in respect of the Contest where they are unable to do so as a result of circumstances beyond its control and shall not be liable to compensate the participants in any manner whatsoever in such circumstances.

All rights and privileges herein granted to the Organisers are irrevocable and not subjected to rescission, restraint or injunction under any and all circumstances. Under no circumstances shall the participants have the right to injunctive relief or to restrain or otherwise interfere with the organization of the Contest, the production, distribution, exhibition and/or exploitation of the Contest and/or Programme and/or any product based on and/or derived from the Contest and/or Programme.

The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the Terms and Conditions of the Contest.
