BRIEF DESCRIPTION OF CONTEST

1.1

The 'I MAS Travel' is a contest organized by Malaysian Airlines System Berhad (the "Organiser").

1.2

There shall be three (3) winners for this Contest and they will receive Malaysia Airlines holiday packages to two destinations, Yahoo editorial training session and a page in Yahoo! Travel to document their holiday experience. Details of the prizes are highlighted under Clause 8 of these terms and conditions, as set out below.

2)

INTRODUCTION

2.1

The Contest is subject to these terms and conditions ("Terms and Conditions").

2.2

The contest starts from 00:01, 26th February – 11:59, 15th April 2011 ("Entry Deadline"). Entries received after the Entry Deadline will be ineligible to participate in the Contest and hereafter to win any prizes.

2.3

The Organiser reserves the right to vary, postpone or re-schedule the dates of the Contest or extend the Contest Period at its sole discretion.

2.4

The brief mechanism of the Contest is as follows:-

2.4.1

Participant has to be a member of mastraveller.com. Sign up as a member or if participant is already a member, log into your account.

2.4.2

Once logged in, submit your best travel related blog post. It can be an entirely new post, or it can be an old post from that exciting holiday you went previously. Submit together a one minute video introduction of yourself and tell the judges why you deserve to win. The profile video is optional but carries an additional point that will help increasing your total score.

2.4.3

Once an entry has been submitted, participant has to promote the submission to their friends and readers. A Facebook ‘Like’ button will be placed together with participant’s submission on Mastraveller. The number of ‘likes’ achieved contribute to your overall score. Only the total number of Facebook ‘Likes’ on the contest page in Mastraveller.com is eligible to be counted as valid contest votes.

2.4.4

A list of Top 15 highest scorer’s finalists shall be announced at I MAS Travel page tentatively on 25th April 2011. There will be a winner announcement event and the details will be communicated directly to the finalist via email or other means on best effort basis. This will be a private event. Invited finalists are allowed to bring two friends to the event. At the event, winners will receive an official award letter and a contract. If there is any winner who does not agreeable or able to fulfill the contract requirement, the prize will be given to the next highest scorer’s. The Prize (as hereinafter defined) is subject to the Terms and Conditions set out herein.

2.5

The Organiser reserves the right at any time to change, amend, delete or add to the Terms and Conditions and other rules and regulations including the mechanism of the Contest at its absolute discretion.

2.6

The Organiser may terminate or suspend the Contest at any time at its absolute discretion in which case, the Organiser may elect not to award any prizes. Such termination or suspension shall not give rise to any claim by the Contestants. If the Contest is continued by the Organiser, the Contestant shall abide by the Organiser’s decision regarding the continuation of the Contest and disposition of the prizes.

3)

CONTEST ENTRY

3.1

Participant must be a registered member of Mastraveller.com and logged in at point of submitting the entry.

3.2

Submission blog entry must be in English. Participants can submit more than one blog entry. Participants are not allowed to submit on behalf of other individuals. Participants must own the rights of the submission content; MAS and Yahoo are not liable for removal of contest submission due to copyright infringement. This includes and not limited to write ups, photos, animations, videos or any other type of content format submitted.

3.3

All submitted contest content shall be owned by Malaysia Airlines and Malaysia Airlines reserves the right to reproduce these content in any format it deems necessary

3.4

Submission of the blog post does not guarantee participants the opportunity to participate in the Contest. The Organiser shall be entitled to reject or refuse participation by the participants for any reasons whatsoever, including (without limitation) where the participant’s contact details at mastraveller.com database is not complete, illegible or any provisions in the Terms and Conditions are not fulfilled or adhered to by the participant.

3.5

By submitting an entry, participants shall be deemed to have read, understood, accepted and agree to be bound by the Terms and Conditions of the Contest.

4)

ELIGIBILITY

4.1

The Contest is open to all Malaysian citizens aged 18 years and above as at 1st April 2011.

4.2

Participants may be required to submit further proof of their eligibility within such timeframe as may be required by the Organiser failing which the Organiser shall be entitled to disqualify the participant.

4.3

The following persons shall not be eligible to participate in the Contest:-

4.3.1

employees of Malaysian Airlines System Berhad and Yahoo! Malaysia Sdn. Bhd., and their subsidiaries and affiliates, agencies, sponsors, dealers, retailers, or any company associated with the Contest and the immediate family members of such persons;

4.3.2

any bankrupts or un-discharged bankrupts; or

4.3.3

if the person has been convicted of any criminal offence prior to the Contest.

5)

DISQUALIFICATION

5.1

The Organiser reserves the right to disqualify a participant and/or revoke any Prizes (as hereinafter defined) at any stage of the Contest if:-

5.1.1

the participant does not meet any of the eligibility criteria;

5.1.2

the participant breaches any of the Terms and Conditions or other rules and regulations of the Contest or violates any applicable laws or regulations; or

5.1.3

in the Organiser’s sole determination, it is believed that the participant has attempted to undermine the operation of the Contest in any way whatsoever, including but not limited to fraud, cheating or deception.

5.2

In the event of a disqualification after a prize has been awarded, the Organiser reserves the right to demand for the return of the Prize or payment of its value from the ineligible or disqualified winner.

6)

WARRANTIES

6.1

The participant represents and warrants to the Organiser that :-

6.1.1

he/she has the right, authority and power to enter into the Contest in accordance with Terms and Conditions and shall provide such proof as the Organiser requires;

6.1.2

all personal details submitted by the participant to the Organiser are true correct accurate and complete.

7)

DECISION OF THE JUDGES/ORGANISERS

7.1

The Organiser will select the winner from all the entries received by the Entry Deadline. The selection of the winner shall be based on the number of likes from the blog post that contributes 30% of the total point and another 70% under judges’ decision based from originality, creativity, fact accuracy and personality of the blog write up, photos and the submitted profile video.

7.2

The Judges/Organiser’s decision on matters relating to the Contest (including without limitation, the selection of the questions and winners) shall be final and absolute. No discussion, correspondence, enquiry, appeal or challenge by any of the partipants in respect of any decision of the Organiser shall be entertained.

8)

PRIZES

8.1

The winners shall be entitled to win the prizes as below (the "Prize"):

  • 5 Days 4 Nights holiday package for two (2) to Auckland, New Zealand
  • USD500 cash allowance for each holiday packages.
  • 1 Day Yahoo editorial training session in Singapore, all-inclusive return economy class ticket from Kuala Lumpur for one person
  • Personal page at Yahoo! Travel website

Runner up

  • 6 Days 4 Nights holiday package for two (2) to Cape Town, South Africa.
  • 5 Days 4 Nights holiday package for two (2) to Seoul, Korea.
  • USD500 cash allowance for each holiday packages.
  • 1 Day Yahoo editorial training session in Singapore, all-inclusive return economy class ticket from Kuala Lumpur for one person
  • Personal page at Yahoo! Travel website

Third

  • 5 Days 4 Nights holiday package for two (2) to Perth, Australia.
  • 5 Days 4 Nights holiday package for two (2) to Tokyo, Japan.
  • USD500 cash allowance for each holiday packages.
  • 1 Day Yahoo editorial training session in Singapore, all-inclusive return economy class ticket from Kuala Lumpur for one person
  • Personal page at Yahoo! Travel website

8.2

The ticket includes airport tax, fuel surcharge, insurance and administrative fees. Any airport user fees including airport tax or excess baggage which are collected separately by local airport authorities at point of check-in will be borne by the winner.

8.3

In the event the winner is not able to receive, take up and/or utilize the Prize as detailed for reasons not attributed to the Organiser, the Organiser reserves the right to select an alternative winner. The Organiser shall not arrange for another prize or compensation in kind.

8.4

The winner is required to provide contact details, passport, NRIC or birth certificate numbers and any other details that may be deemed necessary and relevant for the Organiser in its sole discretion, as and when requested/notified by the Organiser for the purposes of verification. Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to the Organiser does not denote proof that the Organiser has received such details.

8.5

The Organiser reserves the right to forfeit any prizes due to the failure of any winner to provide the required details upon receiving the request/notification from the Organiser and the Organiser shall have no liability to the winners in any respect whatsoever. The Organiser reserves the right to appoint a third party to conduct the verification of winner and the winner agrees that the Organiser may provide all necessary information of the winner to such third party to facilitate such service.

8.6

The Organiser does not guarantee the availability of the Prize and the Organiser shall be entitled to replace and/or substitute such Prize(s) with any other prize(s) of similar value as determined by the Organiser, at its sole discretion.

8.7

The Prizes are strictly non-transferable, assignable, exchangeable or redeemable by the winner in any other form or manner other than that specified by the Organiser. All specific or special terms and conditions that are attached to the Prize must be adhered to by the winner.

8.8

The winner is responsible for any and all taxes, levies or duties payable as a result of a Prize being awarded or received (if applicable).

8.9

In the event that the winner chooses not to accept a Prize, the Prize shall be forfeited and the Prize shall be dealt with in accordance with the absolute discretion of the Organiser.

8.10

The Prizes are accepted entirely at the risk of the winner and is awarded by the Organiser without any warranty of any kind, either express or implied. The winner shall execute a deed of release and indemnity in a form prescribed by the Organiser, if so required, in order to receive the Prize.

8.11

Prizes must be collected in accordance with the dates and destinations specified by the Organiser, failing which it shall be forfeited. No cash alternative or alternative arrangement will be offered by the Organiser, its agents or sponsors.

8.12

Prizes must be collected in accordance with all terms and conditions as may be set by the Organiser, including (without limitation) the following:-

8.12.1

the General Conditions of Carriage of the airlines;

8.12.2

the terms and limitations of any insurance policy relating to the Prizes; and

8.12.3

the terms and conditions in connection with all health and safety guidelines and instructions and all applicable legal and regulatory requirements.

8.13

The winner must hold a valid passport with at least one (1) year’s validity period. It shall be the responsibility of the winners to obtain the necessary visas and other travel documents at their sole cost and expense. No compensation whatsoever will be given should the winners fail to obtain such documents, regardless of the circumstances.

8.14

Passport control and in-country authorities reserve the right to refuse entry. If a winner is refused passage, entry or exit to or from the country being visited, the Organiser will not be responsible in any way to compensate the winner for such refusal of passage, entry or exit and any additional costs incurred will be at the sole cost and responsibility of the winner.

8.15

Notwithstanding any provisions herein and/or in the event of unforeseen circumstances or circumstances beyond the reasonable control of the Organiser. The Organiser reserves the right to offer alternative arrangements of approximately similar value. No cash alternative will be offered.

9)

GOVERNING LAW

9.1

The Terms and Conditions of the Contest shall be construed, governed and interpreted in accordance with the laws of Malaysia.

10)

GENERAL

10.1

The Organiser, its agents, sponsors and representatives shall not be liable to perform any of their obligations in respect of the Contest and these Terms and Conditions, rules and regulations in respect of the Contest where they are unable to do so as a result of circumstances beyond its control and shall not be liable to compensate the participants in any manner whatsoever in such circumstances.

10.2

All rights and privileges herein granted to the Organiser are irrevocable and not subjected to rescission, restraint or injunction under any and all circumstances. Under no circumstances shall the participants have the right to injunctive relief or to restrain or otherwise interfere with the organization of the Contest, the production, distribution, exhibition and/or exploitation of the Contest and/or Programme and/or any product based on and/or derived from the Contest and/or Programme.

10.3

The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the Terms and Conditions of the Contest.

10.4

The main language of the Terms and Conditions shall be the English language. Any translation to any other language than English shall be for convenience only. In the event of any inconsistency between this English language and any other languages, the English language version shall prevail and govern in all respects.
